1. Acceptance of Terms

By accessing or using the Bishop-Forge application and related services (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Service. Your use of the Service is also governed by our Privacy Policy. These Terms apply to all users, including visitors, registered users, and business account holders.

2. Description of Service

Bishop-Forge provides a cloud-based construction management platform that enables teams to manage field logs, punch lists, schedules, RFIs, daily reports, and team coordination. We may modify, update, or discontinue features at any time.

3. User Accounts

• Provide accurate and complete information
• Maintain the confidentiality of your login credentials
• Notify us immediately of unauthorized account use
• You may not share your account credentials.
• We may suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to:

• Use the Service for unlawful purposes
• Upload harmful, illegal, or infringing content
• Attempt unauthorized access to systems or data
• Reverse-engineer or disassemble the Service
• Use automated tools to scrape or extract data
• Interfere with system performance
• Impersonate any person or entity

5. Intellectual Property

All software, branding, and platform features are owned by Bishop-Forge, Inc. and protected by intellectual property laws.

You retain ownership of content you upload. By uploading content, you grant Bishop-Forge a limited, non-exclusive, royalty-free license to host, store, and display that content solely to operate and provide the Service.

6. Subscription and Billing

• Paid plans are billed in advance on a monthly or annual basis as selected.
• All fees are non-refundable except as required by law or expressly stated in our refund policy.
• We reserve the right to change pricing with 30 days' notice to existing subscribers.
• Failure to pay may result in suspension or termination of your account.

7. Limitation of Liability

To the maximum extent permitted by law, Bishop-Forge shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, resulting from:

• Your use of or inability to use the Service
• Unauthorized access to or alteration of your transmissions or data
• Statements or conduct of any third party on the Service
• Any other matter related to the Service

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability.

9. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. Provisions that by their nature should survive termination will remain in effect.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of Delaware.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by email or through the Service. Your continued use of the Service after changes take effect constitutes your acceptance of the new Terms.
